- In case 202411360 (Harlow District Council), the Ombudsman found "service failure" over communal areas that smelt of urine and cleaners attending without actually cleaning, ordering compensation and an estate management policy.
- In case 202014430 (Metropolitan Housing Trust), a resident's complaint about dirty staircases, cobwebs, litter and stains was upheld, with compensation ordered for delays in the landlord's response.
Both cases turned on the landlord's ability to evidence what was actually done, not just what was scheduled — the strongest argument yet for photo-based visit reporting over a paper rota nobody checks.
Setting Enforceable SLAs with Your Contractor
A cleaning schedule is only as good as the contract holding it in place. RICS's Service Charge Residential Management Code sets the best-practice benchmark for managing and evidencing these costs. When agreeing terms with a contractor, or reviewing an existing one, look for:
- Defined response times: A written commitment for how quickly a reported issue (spillage, odour complaint, damage) is actioned, not just "as soon as possible."
- Photo-based visit reports: Evidence each scheduled visit happened and what was covered, useful for resident queries and service charge accounting.
- Named, DBS-checked staff: Residents are at home around these cleaners; vetting matters more here than in a commercial office.
- Seasonal adjustments: Grit and salt application on external paths in winter, and increased bin store attention in summer heat.
